Don’t Care, Don’t Enforce

Inspired by Judge rules on military gay ban: Says it’s not constitutional (Washington Post 9/10/10) and the MSNBC reports below.

“As an American, a veteran and an Army Reserve officer, I am proud the court ruled that the arcane Don’t Ask Don’t Tell statute violates the Constitution.” — Log Cabin Republicans Executive Director R. Clarke Cooper

“All of these examples demonstrate that the act’s restrictions on speech not only are broader than reasonably necessary to protect the government’s substantial interests, but also actually serve to impede military readiness and unit cohesion rather than further these goals.” — U.S. District Judge Virginia Phillips

“This is another example of activist judges usurping the role of the people and their elected officials. This should be a decision for Congress and the President, not appointed un-elected judges, after Congress and the President receive the Pentagon report on this issue.” – Senator McCain’s office

Supporters say DADT is defensible

Because it for troop morale is indispendable.

Now, a  federal judge has said that rationale

Is what’s actually harming troop morale.

(She makes a good point that DADT’s purported logic falls apart

When you wait until after gays rotate out of combat to force them to depart.)

Ironically, it’s a group of Republicans challenging DADT’s propriety

(Albeit of the Log Cabin variety).

The law is being defended by the Obama Administration,

Which has come out in support of the law’s revocation.

(The latter’s only because Justice is legally obligated

All the laws that Congress has created.)

Erstwhile maverick Senator McCain

Took this chance about the decision to vociferously complain.

(Strangley, McCain wasn’t that upset when the Supremes overturned the people’s will

By invalidating his own campaign finance bill.)

Congressional legislation to repeal DADT and open service permit

Has passed the House but is stalled in the Senate.

Senator, if you’re so unhappy about the lack of legislation,

Stop obstructing the bill for DADT’s termination.

Here’s Hardball’s 9/10/10 panel discussion on the court decision that DADT is unconstitutional. The “don’t care” reference in the title is to the statement made by each of the panelists that the younger generation (both civilian and military) just don’t care if a soldier is gay any more.
